The www.pwprojectwatch.com website is governed by these legal notices, the use of the website implies the reading, knowledge and acceptance by the User of all the terms, conditions, policies and communications set forth in this document. If the User does not agree with the content of the terms of use, he must refrain from using the site.

General provisions

  • For the purposes of these terms of use, the term “Owner” uniquely refers to the owner of the domain www.pwprojectwatch.com while “User” refers to the person who uses the blog of the website itself.
  • The use of the website is governed by these Terms and Conditions, the acceptance of which constitutes an agreement between the User and the Owner.
  • At its sole discretion and at any time, the Owner reserves the right to update, replace or make material changes to these Terms and Conditions. Continued use of or access to the site after the posting of any changes constitutes the complete acceptance by the User of the new Terms. It is the User’s responsibility to periodically check the site for any changes. You will always be able to consult the latest version of the Terms and Conditions at any time on this page. Any new or improved features/tools added/updated to the Site after the publication of this document will also be subjected to the same Terms.
  • The law applicable to the relationships arising from the use of the service is the Italian one, in the light of which these Terms of Use must also be interpreted.
  • By accepting these Terms, the User declares that he/she is of legal age as required by the law of the State of residence, or that he/she is 18 years of age or older.

User Obligations

  • The User is obliged to use the blog of the website and the information through it conveyed in punctual and constant compliance with the law, public order and morality and what is established in these Terms of Use.
  • The User can make comments about the articles published on the blog; the content of the same must not violate mandatory rules, nor cause harm to third parties or the owner of the domain www.pwprojectwatch.com. The User is responsible for the comments posted at the bottom of the blog articles.
  • The User must not reproduce, distribute, communicate to the public, publicly display, represent, perform and/or recite all or parts of the blog. He/she must also not alter its content, as he/she is personally responsible in this regard.
  • The User expressly accepts the possibility that the Owner may, due to technical problems of his own and/or third parties generated by factors or circumstances beyond his control, interrupt and/or suspend the service, without notice, for indefinite periods of time.

Responsibilities of the User

If the User violates the provisions of these conditions of use, the Owner of the Service reserves the right to act either directly for the compensation of any damages by calling the User in question in the event of a claim of rights by third parties.

Obligations, warranties and disclaimers of the Owner

  • The Owner assumes no responsibility that the use of its Service is uninterrupted, timely, secure and/or error-free.
  • The Owner is not responsible for any use of the blog and the services offered by it in violation of law, morality or public order, or in accordance with the requirements of these Terms of Use.
  • The Owner does not exercise any control over the links to third-party websites and their content present on its pages. The Owner assumes no responsibility for the examination or evaluation of such content or the accuracy of the same or any other service provided by third parties. Any use by the User of the tools offered through the site is entirely at his/her discretion and risk. In the event that the link is related to a Site that offers additional services through the Owner, its use will be governed by the conditions of use prepared by the service provider itself. Please review third-party policies and practises carefully and ensure that you understand them. Complaints, concerns or questions regarding third-party services should be directed to such parties.
  • The Owner is not responsible for any damages and/or losses and/or malfunctions and/or prejudices of any kind that may derive from the User’s electronic computer from the use of the blog, nor for any contamination of the computer system resulting from access, interconnection, download of computer material and programs from the blog; the related repair/restoration costs remain the responsibility of the User.
  • The Owner excludes all responsibility for the veracity, accuracy, completeness and relevance of the information made available on the Site. The contents on the Site are to be considered general information and should not be used as primary sources of information. Any reliance that the User makes or may make on the contents and material on the Site is to be considered the sole responsibility of the User him/herself.

Intellectual Property

  • The blog is protected by the legislation in force in Italy on copyright. All content is protected by the current regulatory provisions on the subject. Under no circumstances can the User claim a right to publish the content.
  • The User is prohibited from copying or otherwise learning, publishing, disseminating, transmitting or otherwise making available, even partially and/or as a result of modifications, what is contained in the blog.

Feedback and Comments

If invited to do so or of his/her own free will the User decides to express suggestions, creative ideas, proposals or contributions of any kind and in any form (Comments and e-mail), through the Site, the social channels of PW Project Watch or through contact forms or e-mail, the latter assigns to the Owner a free and non-exclusive license to use all the aforementioned content.

The Holder is not required to:

  • Maintain confidentiality on any Comment;
  • Pay compensation for any comments;
  • Respond to any comments.

Without any obligation, the Owner reserves the right to monitor, edit or remove content that, in his sole discretion, is deemed to be illegal, offensive, threatening, slanderous, defamatory, pornographic, obscene or otherwise objectionable or that seems to infringe the intellectual property of any party or infringe these Terms.

The User hereby declares that his/her Comments:

  • Do not infringe any rights of any third party (including Copyright, Trademark, Privacy, Personality or other personal or proprietary rights);
  • Are not defamatory or otherwise illegal, offensive or obscene, nor do they contain computer viruses or other malware that may in any way affect the operation of this Service or any related website.

The User  declares that he/she does not:

  • Use and/or have provided a false email address;
  • Pretend to be a person other than him/herself or provide information that may mislead the Owner or third parties with respect to the identity with which to associate the Comments made on our channels or on the Site.

The User is aware that he/she is solely responsible for the content of the Comments he/she wishes to issue and any damages that may be generated by the aforementioned to the Owner or to third parties.

Prohibited uses

In addition to the other prohibitions set out in the aforementioned Terms and Conditions, it is prohibited to use the Site or its contents:

  • For purposes that are unlawful and contrary to applicable law, to publish illegal content or to encourage others to commit or participate in unlawful acts;
  • Violate any local or international regulation, rule, law or ordinance (including all applicable laws regarding online conduct and acceptable content, licensing, privacy, data protection, transmission of technical data, the use or provision of financial services, consumer notification and protection, unfair competition and false advertising);
  • Infringe or misappropriate our intellectual property rights or the intellectual property rights of others;
  • For any obscene or immoral purpose;
  • Harass, insult, harm, defame, denigrate, intimidate or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability;
  • Provide false or misleading information;
  • To collect, track or disclose the personal information of others;
  • To send unsolicited messages in bulk;
  • For spam, phishing, spider, crawl or scrape;
  • Upload or transmit viruses or any other type of malicious code that will or may be used in a way that affects the functionality or operation of the Service or any related website, other websites or the Internet;
  • Or to interfere with or circumvent the security features of the Service or any related websites or other websites or the Internet.
  • To interfere with, interrupt or attack any service or network;
  • To create, distribute, or enable material that is, facilitates, or operates in conjunction with, malware, spyware, adware, or other malicious programs or code;

Any breach of these Terms and Conditions will result in immediate termination of the provision of the Service. The Owner reserves the right, at any time, to refuse or limit the provision of the Service to anyone for any reason.

Final provisions

  • The Owner reserves the unilateral right to modify, suspend or interrupt the blog and the services offered for it.
  • The Owner reserves the right, in the future, to offer new services and/or features through its Site, including advertising initiatives through the use of banners and advertisements for the promotion and marketing, direct and/or indirect, of any good, product and service. Those will be subject to these Terms and Conditions.

Applicable law

These Terms of Service shall be governed by and construed in accordance with the laws of the Italian State.

Use of the blog is not authorised in jurisdictions that do not recognise the validity of all provisions issued by means of these Terms of Use, including, without limitation, this paragraph.

The Owner reserves the right, however, to take legal action before foreign and Italian judicial and administrative authorities, if it deems it necessary to protect its own interests and/or those of its Users.

Partial nullity

In the event that any provision of these Terms and Conditions is held to be unlawful, void or unenforceable, that provision shall still be enforceable to the fullest extent permitted by law. This is without prejudice to the validity and applicability of any other surviving provisions.

Compensation

You hereby agree to indemnify, defend and hold harmless the Owner, his partner, and service providers from any claim or demand, including reasonable attorneys’ fees, made by third parties due to or arising out of your violation of these Terms or the documents they incorporate by reference, or from your violation of any law or the rights of any third party.
